Area Council Meetings: Replies to Notices of Motion December 18th 2007

With reference to Notice of Motion no 5, submitted by Cllr. P. McMahon, for the Shannon Electoral Area Committee Meeting, on 18th December, 2007,

To ask Clare County Council as a matter of urgency to install traffic calming measures or investigate a new entrance/exit near the Community Centre on the Ennis Road Newmarket on Fergus due to excessive speed by some motorists

I wish to reply as follows:-

A speed survey was carried out on this road in March 2006.  The 85% percentile speed was 39kph, which indicates that traffic calming is not an issue.  A new entrance/exit was raised previously and it is considered that an additional access point on to the R485 would constitute a traffic hazard.

With reference to Notice of Motion no 6, submitted by Cllr. P. McCarthy, for the Shannon Electoral Area Committee Meeting, on 18th December, 2007,

That a progress report be presented on Derelict sites that are under investigation in the Shannon Electoral Area

I wish to reply as follows:-

  • During the 12 months of 2007 a total of 9 properties have been removed from the Derelict Sites Register in Shannon, in that the Owners complied in full with the requirements of the statutory notices as issued.  These represent single dwellings in various housing developments in the town.
  • Approximately 5 – 6 other properties were identified as derelict but through correspondence with the Owners they were all rendered non derelict even before being included in the Register through the co-operation of the Owners.  Again, these were single dwellings in various housing developments.
  • Specifically the old ESB site has recently been rendered non derelict and removed from the Register.
  • There are a number of sites in Shannon at present in the Drumgeely area, Tradaree and at Foyle Park that are considered derelict and are being followed up.  In a number of cases the Owners are or have applied for Planning Permission and in most cases the Owners have had recent correspondence with the Council.  These will be followed up under the provisions of the Act.
  • One property is currently under investigation and a report is awaited.  This is a single dwelling in a housing development.

If any Elected Representative requires an update on any specific property they can contact the Transportation & Infrastructure Section at any time.

With reference to Notice of Motion no 7, submitted by Cllr. G. Flynn, for the Shannon Electoral Area Committee Meeting, on 18th December, 2007,

That Clare County Council provide off road parking to facilitate the community service being provided by the Senior Citizens centre in Shannon at 9 Purcell Park.

I wish to reply as follows:-

I will investigate the possibility of providing extra public car parking convenient to the Senior Citizens Centre at No. 9 Purcell Park.  I will bring forward proposals for this at the next Electoral Area Meeting.

With reference to Notice of Motion no 8, submitted by Cllr. J. Crowe, for the Shannon Electoral Area Committee Meeting, on 18th December, 2007,

To ask Clare County Council to inspect from the Gullet cross to Guerins Cross this is a very bad stretch of road and it needs urgent attention as there is a lot of bends in it.

I wish to reply as follows:-

This County road links the Gallows Hill area from Gullet Cross to the Cooleycasey Road near Sixmilebridge.  The road surface is quite good and the road does not presently need strengthening or surface dressing.  There are some bends on the road, which is not considered unusual for a secondary county road where traffic is light.  Local road widening has occurred at various locations along the road where new houses have been built.

With reference to Notice of Motion no 9, submitted by Cllr. P. McMahon, for the Shannon Electoral Area Committee Meeting, on 18th December, 2007,

To ask Clare County Council to upgrade the infrastructure i.e lighting and footpaths in Kilnasoolagh Park Newmarket on Fergus

I wish to reply as follows:-

I have inspected the public lighting and footpaths in Kilnasoolagh Park.  The public lighting is in good condition generally.  There are at present 3 lights out of action in the estate.  One of these is expected to be repaired this week.  The other two involve an underground cable fault and will be repaired as soon as possible.  The footpaths in the estate are generally in good condition as extensive resurfacing was carried out a few years ago.

 That road markings be provided on Ard Coinn.

With reference to Notice of Motion no 11, submitted by Cllr. G. Flynn, for the Shannon Electoral Area Committee Meeting, on 18th December, 2007,

That Clare County Council inspect the adequacy of the entire service network in the Kilnasoolagh Park area covering roads, footpaths, waste water, drainage, gulleys, lighting and landscape works etc.

I wish to reply as follows:-

An inspection has been carried out in Kilnasoolagh Park re roads, footpaths, waste water drainage, gulleys, lighting and landscape works.  The roads and footpaths have been upgraded by extensive resurfacing in recent years and are in good condition.  Road gullies are all working satisfactorily.  Public lighting is all in good condition.  Open spaces and landscaping works are all well maintained.

Problems have been occurring in the foul sewerage network at Kilnasoolagh over the past couple of years.  The sewer has over flowed near the new Council houses on a number of occasions during very have rainfall.  This is due to infiltration of ground water into the system.  This has been mitigated over the past 12 months by lining the sewer where the infiltration was occurring.  Further improvements will materialise next year when a storm water tank will be constructed at the sewerage treatment plant, which will prevent the surcharging of the system near the new houses.  Surcharging of the foul sewerage system is also a problem at a manhole where the rising main from Carrigoran Nursing Home discharges.  It is intended to lay additional pipe work from this manhole to the treatment plant in order to alleviate this problem.

With reference to Notice of Motion no 12, submitted by Cllr. J. Crowe, for the Shannon Electoral Area Committee Meeting, on 18th December, 2007,

To ask Clare County Council if a time limit could be put on parking in the Square in Sixmilebridge.

With reference to Notice of Motion no 13, submitted by Cllr. P. McMahon, for the Shannon Electoral Area Committee Meeting, on 18th December, 2007,

Due to the huge amount of extra ownership of vehicles in Kilnasoolagh Park Newmarket on Fergus.  I ask Clare County Council to investigate extra parking in this estate.

I wish to reply as follows:-

I have investigated the car parking situation in Kilnasoolagh Park.  The parking within the estate includes public spaces and private spaces.  A significant number of house owners have provided car parking within the curtilege of their property, generally at the front. A number of houses have provided car parking at the back of their house.  Any other houseowners requiring additional car parking can provide it within their own property. 

I am aware that indiscriminate parking can lead to difficulties with access on the public road and in order to address this problem I recommend the installation of double yellow lines at the junction near house no 48 & 50.

With reference to Notice of Motion no 14, submitted by Cllr. P McCarthy, for the Shannon Electoral Area Committee Meeting, on 18th December, 2007,

That in view of the serious and abnormal flooding that occurred in Drumgeely on 6th Dec 07 a report be presented on the cause and solutions to ensure that there is not a repetition of the situation. 

I wish to reply as follows:-

The prolonged intense rain on 6th December resulted in road and land flooding throughout the County.  In the Shannon Electoral Area the most serious road flooding was in Sixmilebridge and surrounding areas.  There was road flooding at a number of locations in Drumgeely including Corrib Drive.  In most cases the road flooding in urban areas occurs when gully gratings become clogged with debris such as leaves, litter, etc which washes into the gratings of the gullies.  In some cases the flooding occurs because the underground gulley or the pipework from the gully to the main drain has reduced capacity due to build up of silt etc. The road flooding, which occurred in Drumgeely, occurred from the same reasons as outlined above for urban areas - with the build up of leaves being the main reason.  The Council's outdoor staff were all diverted to deal with flooding problems on Thursday 6th December and again on Friday.

The Council endeavours to ensure that all road outlets are opened, gullies and pipework cleaned out in as much as is possible.  In areas such as Drumgeely gullies are cleaned out once each year while pipework is cleaned out as the need arises.  Notwithstanding these measures it is inevitable that rainfall such as occurred in this case will result in surface water run-off which will, especially at this time of the year, bring leaves etc. to the gullies resulting in flooding at some of them.

With reference to Notice of Motion no 15, submitted by Cllr. G. Flynn, for the Shannon Electoral Area Committee Meeting, on 18th December, 2007,

That Clare county Council Planning section give an up to date report on the public park in Shannon

  • Have developers adjacent to the park complied by conditions imposed on them in relation to the park
  • Could the Council give an indication when it may be possible for management of this public facility be taken over by the Council

I wish to reply as follows:-

Applicants in respect of P02/2021 recently met with the Area Manager, area engineering staff and the area planner.  At that meeting the issues in the context of the planning permission granted and in terms of the overall maintenance of the park were outlined and discussed with representatives of the developer.  It was agreed that they would address a schedule of issues provided to them on the 16 October 2007. 

It is clear that much progress has been made in recent weeks in addressing issues and a detailed submission was recently received from the developers in response to the issues raised. This submission is currently being examined and outstanding issues will be pursued with the developer.

Until such time as all works are completed to a satisfactory standard, the park will not be considered for taking in charge by the Council.

With reference to Notice of Motion no 16, submitted by Cllr. J. Crowe, for the Shannon Electoral Area Committee Meeting, on 18th December, 2007,

To ask Clare County Council to resurface and line the car park in front of the Wells Church as this car park could be used as an overflow car park for the school.

I wish to reply as follows:-

The Council has provided road lining at the Wells School.  I will arrange to have this lining extended into the adjoining car park at the Church.
