Area Council Meetings: Replies to Notices of Motion 18th November, 2008

With reference to Notice of Motion no 6, submitted by Cllr. J. Crowe for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

That Clare County Council undertake remedial road surfacing works as a matter of urgency on the Hill Road, Bunratty, Co. Clare.   This road is in a bad state of repair with several bad potholes.

I wish to reply as follows:-

This road will be considered for resurfacing next year as part of the Road Works Programme.  Potholes on this road have recently been repaired.

With reference to Notice of Motion no 7, submitted by Cllr. P. McCarthy for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

That the Council put in a pipe and raise the footpath in front of house no 78 Aidan Park to alleviate constant flooding in this area.

I wish to reply as follows:-

This footpath is included in the list of footpaths selected and prioritised by Shannon Town Council for the purposes of obtaining a grant next year under the Block Grant for former Town Commissioner Areas.  The footpath will be raised and surface water drainage provided as deemed necessary to solve the flooding problem here.

With reference to Notice of Motion no 8, submitted by Cllr. P. McMahon for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

To ask Clare County Council to resurface the car park in the vicinity of the Catholic Church Newmarket On Fergus.

I wish to reply as follows:-

This car park serves the needs of people attending Church Services.  It has a good quality gravel surface.  A section of the car park has recently been overlaid with bituminous macadam by the Church Authorities.  I do not envisage the Council being involved in surfacing of the car park.

With reference to Notice of Motion no 9, submitted by Cllr. G. Flynn for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

That the Director of Service for Transportation & Infrastructure give a written report in relation to the staffing levels of our maintenance crew in the Shannon Area.

  1. The total number of crew
  2. The ratio of permanent workers against workers on short contracts

The total number of employees in the Directorate of Transportation & Infrastructure in the Shannon Electoral area is 27 of whom 23 are permanent and 4 are on temporary contracts.

With reference to Notice of Motion no 10, submitted by Cllr. J. Crowe for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

From Coolycasey cross on the Limerick road there is a 2 mile stretch of very bad sharp bends that need warning signs and I ask that these signs be erected as soon as possible

I will arrange to have appropriate warning signs erected on the section of road as soon as possible.

With reference to Notice of Motion no 11, submitted by Cllr. P. McCarthy for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

That the Council replace the fence that has been removed from the green at the rear of house no's 142-149 Tradaree Court

I wish to reply as follows:-

In this row of houses, only one house is owned by Clare County Council.  As per our enquiries to date no Contractor employed by the Housing section removed this fence. However, the matter will be further examined in light of the current remedial works programme and in consultation with the Department of the Environment, Heritage and Local Government.  Should approval be given, it is most likely that the cost of the repairs associated with the privately owned houses will have to borne, at least in part, by the owners.

I will arrange for a cost estimate to be prepared and for a formal submission to be made the Department.

With reference to Notice of Motion no 12, submitted by Cllr. P. McMahon for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

To ask Clare County Council to resurface the footpath in the proximity of the Pedestrian Crossing opposite Obair in the village of Newmarket on Fergus.

I wish to reply as follows:-

This path is in poor condition over a relatively short length.  Resurfacing of the path will be considered for funding next year as part of the Road Works Programme.

With reference to Notice of Motion no 13, submitted by Cllr. G. Flynn for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

That Clare County Council in the future, advise the Elected Members of any new infrastructure being provided by the Council where no such structure existed previously for example footpaths, cycle lanes, roads, walls, etc.

I wish to reply as follows:-

It is essential that the Council retains the flexibility which allows its staff to make day to day operational decisions as they arise including those decisions which involve provision of new infrastructure.  It is unnecessary to change the long established practice in this matter.

With reference to Notice of Motion no 14, submitted by Cllr. J. Crowe for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

On the Lower Road in Bunratty there is continuous flooding in front of Foxes, Jones, Darcy and O'Donnell homes.  This flooding is at a very dangerous bend on the road and it has got extremely worse in the last 12 months.  I request that this would be investigated because this is a very busy road.

I have arranged for drainage improvement works to be carried out at this location.

With reference to Notice of Motion no 15, submitted by Cllr. P. McCarthy for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

That Clare County Council take possession of Park Hall, Drumgeely and demolish this building immediately as it is a hazard and a source of nuisance.

I wish to reply as follows:-

There have been concerns expressed regarding the condition of this building at meetings of Shannon Town Council and meetings of Shannon Area Committee.  The Council inspected this property on 24th June, 2008.

It was clear from inspection of the property that there are major structural issues in relation to the foundations and it is understood that Shannon Youth Services Council have also obtained a Structural Engineer’s report on the building.  The Council also understands that Shannon Youth Services Council/Clare Youth Services do not wish to proceed with any major works on this property.  In any event, it is clear that any development of the property will require a complete demolition, a new foundation and new structure.  Arising from this, it would seem that the priority should be to have the property demolished, eliminate a structurally unsafe building and also a building, which in its present state is causing nuisance to local residents through its condition and abuse of the property and surrounds.

Following the inspection, the Council wrote to a representative of the group and indicated that it is primarily a matter for Shannon Youth Services Council Ltd./Clare Youth Services to decide on the approach it wishes to take in relation to the building.  In the event that Shannon Youth Services Council Ltd./Clare Youth Services wish to transfer responsibility for the building to Clare County Council, Clare County Council would accept such responsibility on the basis that immediate demolition of the building and clearance of the site would take place by Clare County Council.  Any future proposal by a Community Group or organisation for development on the site could then be considered on its merits and any future disposal of the site to any party would be on the basis of a decision of the elected members of Clare County Council.

Having checked on the legal status of the building, it appears that the property is registered in the name of Clare County Council as the legal papers for the transfer of the building to Shannon Youth Services Council Ltd./Clare Youth Services were never formally registered in the Land Registry.

The Council received correspondence from Solicitors for Shannon Youth Services Council Ltd. on 13th November 2008 indicating that Shannon Youth Services Council Ltd. “believe that it would be in everyone’s interests for Clare County Council to assume control of the property” Clare County Council will progress the matter in conjunction with the Solicitors for Shannon Youth Services Council Ltd.

With reference to Notice of Motion no 16, submitted by Cllr. P McMahon for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

To ask Clare County Council that any work that is carried out in Leiminagh Graveyard that all debris be removed and not left on the site of the graveyard.

I wish to reply as follows:-

I presume this refers to waste material which arises when graves are dug and when maintenance is carried out on graves and also when work is carried out by contractors who erect headstones etc.  A more active involvement by the Community to keep all the local burial grounds neat and tidy would greatly help in this regard.  The Council has erected an appropriate notice in the graveyard regarding disposal of waste etc.

With reference to Notice of Motion no 17, submitted by Cllr.  G. Flynn for the Shannon Electoral Area Committee Meeting, on 18th November, 2008,

In view of the departure by the ESB from the maintenance of street lighting that a written report be provided outlining what type of service will be provided by Clare County Council in the future

I wish to reply as follows:-

The existing maintenance agreement between the Council and the ESB covers the period up to the end of 2008.  Contract documentation is currently being progressed with regard to the selection of a contractor to provide for maintenance of the public lighting network throughout the County when the ESB’s involvement ceases.  It is likely that the ESB’s contract will be extended until a new contractor is appointed.  This matter is being progressed at Senior Engineer and Director of Service level within the Transportation & Infrastructure Directorate.
