With reference to Notice of Motion no 7, submitted by Cllr. J Crowe for the Shannon Electoral Area Committee Meeting, on 21st July, 2009
I am requesting an update on the measures that were taken to prevent flooding in the Ministers Cross area, especially an update on the pipes crossing the road from the Bed & Breakfast to O' Gradys on the other side of the road.
I wish to reply as follows:-
Following the flooding which occurred in August 2008 as a result of exceptionally heavy rainfall, which occurred over a short duration, Clare County Council cleaned the open drain along the R471 regional road and jetted the pipe crossing the road. A bucket had become lodged in the pipe, which resulted in a blockage. This blockage was removed and the pipe is now clear allowing surface water to flow more freely.

With reference to Notice of Motion no 8, submitted by Cllr. P McMahon for the Shannon Electoral Area Committee Meeting, on 21st July, 2009
Bearing in mind that the Department of the Environment, Heritage and Local Government has yet to issue guidance to planning authorities on public safety zones at the State Airports some 4 years after the publication of the final ERM Report, to ask the Council to explain why it jumped the gun so to speak by designating what can only be described as massive if not obscene public safety zones in the South Clare Economic Corridor Local Area Plan 2003
I wish to reply as follows:-
The PSZ’z have been in existence since 1977, and the current PSZ zones incorporated into the South Clare Local Area Plans of 2003 and 2009 after full public consultation, and at the request of Aer Rianta in their submission to the preparation of the South Clare Local Area Plan2003. This is in line with the procedures followed by other Planning Authorities – including Dublin and Cork, as these authorities have all incorporated PSZs zones into their plans.

With reference to Notice of Motion no 9, submitted by Cllr. G Flynn for the Shannon Electoral Area Committee Meeting, on 21st July, 2009
That in view of the availability of disability funds that Clare County Councils local Engineer survey all local public facilities and other service providers in the area with a view to providing better access for people with a disability or other special needs.
I wish to reply as follows:-
Clare County Council received a grant of €370,316 in 2009 from the Department of the Environment, Heritage and Local Government under the National Disability Funding Allocations. This grant is made up of current funding and capital expenditure. Current funding accounts for €48,744 and is to be used to manage the local authority implementation programme to provide disability awareness training, to adapt information systems and provide access equipment for people with disabilities. Capital expenditure accounts for €321,552 and is to be used to address the priority needs of people with disabilities by providing and improving accessibility to public buildings, roads pavements, parks, amenities, heritage sites and other public areas. The Shannon Electoral Area has been allocated €40,000 under the capital expenditure programme. Engineering Consultants White, Young and Green have undertaken an accessibility audit in County Clare and it is expected that their report will be issued shortly.

With reference to Notice of Motion no 10, submitted by Cllr. T Mulcahy for the Shannon Electoral Area Committee Meeting, on 21st July, 2009
That this Council would clarify the role of Clare County Council in the provision of a set down area at Scoil Na Maighdine Mhuire, Newmarket On Fergus.
I wish to reply as follows:-
In my opinion, it is the responsibility of the Department of Education and Board of Management to provide a set down area at this school. Clare County Council is not in a position to fund such a scheme but can assist in providing technical advice.

That Clare County Council remove those trees on Tullyglass Hill that are a danger to adjacent houses
I wish to reply as follows:-
I have engaged the services of a specialist contractor to undertake tree felling and surgery works on Tullyglass Hill and throughout Shannon. Funding for this work is limited and I am at present assessing which trees pose the greatest risk of causing damage to nearby dwellings and prioritising their removal.

With reference to Notice of Motion no 13, submitted by Cllr. PJ Ryan for the Shannon Electoral Area Committee Meeting, on 21st July, 2009
That Clare County Council give a date for commencement of work on the road surface from Jamaica Inn to Castlecrine Cross (Broadford Road).

Resurfacing works commenced on this road on Monday 20th July 2009. Surface dressing works will commence on this road during the week and further road strengthening works near Castlecrine Cross will take place in late August 2009.

Replacement pole is requested for Thomond Terrace, Sixmilebridge as the pole split from top to bottom and is a danger as there is a public light on this pole.

With reference to Notice of Motion no 15, submitted by Cllr. P McMahon for the Shannon Electoral Area Committee Meeting, on 21st July, 2009
To ask Clare County Council to install a set down area at the front of Newmarket on Fergus National School. A recent health & safety report commissioned by the Board of Management highlighted that there is a high probability of a serious accident due to the high volume of traffic and the current layout. A set down area similar in design recently installed at Clarecastle National School would also suit the area in front of Newmarket On Fergus National School.
I wish to reply as follows:-
In my opinion, it is the responsibility of the Department of Education and Board of Management to provide a set down area at this school. Clare County Council is not in a position to fund such a scheme but can assist in providing technical advice. I have not seen a copy of the Health and Safety report commissioned by the Board of management and therefore it is difficult for me to comment on the risks identified within the report. I assume the risk of a serious accident occurring is as a result of traffic congestion which is caused by parents either dropping off or collecting their children directly outside the school in the mornings and afternoons. There are double yellow lines on the road in front of the school which prohibit parking. Perhaps the school’s board of management should advise parents to observe the rules of the road and encourage them to park in the lay-by provided, which is located only a short distance from the school on the opposite side of the road. The lay-by is 150 metres in length and can easily accommodate up to 30 parked vehicles. The recently installed set down area in front of Clarecastle’s National School does not improve road safety as has been highlighted in a recent safety audit of children’s movements in the vicinity of the school’s entrance and at the school warden’s crossing near the school. The audit in fact states that the set down area becomes congested with carelessly and haphazardly parked cars at school closing times. It also emphasizes the serious safety risks for children who find themselves meandering between moving cars in the set down area. I believe a “drop off” circulation system within the school grounds similar to the attached drawing would be a more suitable option for a set down area.

That Clare County Council open up the walkway from Illaunagowan Point to Tullyglass point - this section of walkway is overgrown and in very bad condition and is a very important local amenity.

The grass along this section of walkway has recently been cut and remedial works to restore the width of the gravel footpath are scheduled to commence shortly.

for the Shannon Electoral Area Committee Meeting, on 21st July 2009
That Clare County Councils sell some land at the side of 19 Slaney Park to Mr Bernard Kennedy
I wish to reply as follows:-
Since taking over the services and property from Shannon Development in 2004 the Council has had a substantial number of requests from householders to purchase small areas adjacent to their dwellings and the Council has been able to facilitate most of these requests.
Particular issues arise as regards some requests because of their location and the location of services such as public footpaths, water mains and sewers and such requests have to be dealt with having regard to the particular circumstances applying
In the case of the specific case referred to here the position is as follows
The person made contact with Council some years ago outlining his interest in purchasing an area adjacent to his dwelling. The Council responded in 2005 outlining issues to be considered as regards any proposed sale of an area in this case.
These issues included:
(a) That there is a public footpath crossing the area in question and this would have to be replaced at the householder’s expense.
(b) There is a sewer crossing the area in question and a way leave would have to be entered into.
(c) The area in question would be for the enjoyment of the existing dwelling and no development could take on the land.
It will also be necessary as has been done with other such requests to bring any proposed sale to the attention of neighbouring households in view of the necessary re-location of the public footpath and the use of what is now an open space by the individual householder.
The Council has no record of any response from the householder with his intentions since 2005.
If the householder still wishes to pursue the matter, the above issues will have to be taken into consideration.

That Clare County Council remove some trees and trim back the rest adjacent to number 12 Cronan Park as the residents consider them dangerous at present.
I wish to reply as follows:-
I have made arrangements to have the overhanging branches of these trees cut back. This work will be undertaken within the next two weeks

That Clare County Council carry out the necessary road re-alignment at Keane's bend on Sixmilebridge/Kilmurry Road.
I wish to reply as follows:-
Clare County Council has no plans to realign the R462 Sixmilebridge to Kilmurry Regional Road at Keane’s bend in the short to medium term. The Council will, however, erect improved warning signage alerting motorists of bends on this road.

There is a dangerous pole at the entrance to Inis Ogra estate, Sixmilebridge, this pole is positioned on the entrance which is causing concern to the residents.
I wish to reply as follows:-
The planning authority has issued an enforcement notice in relation to the completion of works in this estate. The notice requires that all footpaths and roads be constructed in accordance with the “Recommendations for site development works in housing estates”. This includes setting back of poles so that visibility lines at entry and exit points to estates are not impaired.

To ask Clare County Council to put in place speed ramps in Plunkett Drive, Kilkishen due to excessive speed of a minority of motorists
I wish to reply as follows:-
This office will be responsible for maintaining this road from1st January 2010. As such, I will arrange for an assessment to be undertaken in line with Clare County Council’s traffic calming policy for residential areas to determine if traffic calming measures are warranted on this road.

That in view of the danger to the public from large trees that Clare County Council remove a number of trees throughout Shannon;

That Clare County Council in consultation with the Gardaí to put a plan in place to tackle the on going problems with anti social behaviour in Shannon Town.
I wish to reply as follows:-
Local Authorities, including Shannon Town Council are required under the Garda Siochana Act, 2005 to establish a Joint Policing Committee (JPC) for their area. The JPC’s function is to serve as a forum for consultations, discussions and recommendations on matters affecting the policing of the local authority’s administrative area. In particular the JPC will keep under review the levels and patterns of crime, disorder and anti-social behaviour in their area. The first meeting of the Shannon JPC will be held in September, and it is suggested that this motion be referred to same.

That Clare County Council solve the flooding problem, which is affecting house nos 42-47 Cill Cais in particular.

I have made arrangements to have the gullies and storm water pipelines jetted to the rear of these houses. Any blockages that are found in pipe runs and gully pots will be removed.

To ask Clare County Council to give a progress Report on Pedestrian Crossing at Pound Street, Sixmilebridge and also give a definite commencement date
I wish to reply as follows:-
Funding for a pedestrian crossing has been secured under the Low Cost Safety Improvement Grant Scheme. The pedestrian crossing will be sited on Pound Street north-east of the Shannon Road / Rossmanagher Road junction opposite the footpath leading to the Catholic Church. Works are planned to commence on this crossing during November 2009.
