of Motion July 18th 2006
With reference to Notice of Motion No. 7, submitted by Cllr. P. McCarthy,
for the Shannon Electoral Area Committee Meeting, on 18th July, 2006,
That the main footpath in Lemenagh burial ground be resurfaced.
I wish to reply as follows:-
The annual funding provided for burial ground maintenance works is limited.
The Councils area engineering staff will assess the condition of the footpath
in Lemenagh burial ground and report on the estimated cost of works. The
source of funding can be further explored at that stage.

With reference to Notice of Motion No. 8, submitted by Cllr. P. McMahon,
for the Shannon Electoral Area Committee Meeting, on 18th July, 2006,
That Clare County Council put a speed limit in place urgently in the
direct vicinity of the Stonehall National School due to the reckless driving
of some motorists.
I wish to reply as follows:-
I will arrange for a vehicle count and speed survey to be undertaken
at Stonehall National School as soon as possible to determine the extent
of the problem. This will enable me to make an informed decision as to
whether or not a revised speed limit necessary.

With reference to Notice of Motion No. 9, submitted by Cllr. G. Flynn,
for the Shannon Electoral Area Committee Meeting, on 18th July, 2006,
That the local roads in the Tullyvarraga hill and Gleann na Smol areas
be fully resurfaced as the policy of patching these roads has failed and
the re-occurrence of pot holes on these roads may lead to a serious accident
I wish to reply as follows:-
I inspected the road network in Tullyvarraga Hill and Glean na Smol areas
and consider that 700 metres of the Tullyvarraga Hill road and 230 metres
of the Inis Beag road which provides access to the Glean na Smol estates
would benefit from resurfacing. While all resurfacing schemes have to
be prioritised and are subject to budget constraints, I am hopeful that
these schemes will take place in 2007 under the Non-National Roadworks
Programme.

With reference to Notice of Motion No. 10, submitted by Cllr. J. Crowe,
for the Shannon Electoral Area Committee Meeting, on 18th July, 2006,
I request that the water pressure in Sixmilebridge be checked- areas
especially around Church View are experiencing very low pressure
I wish to reply as follows:-
There have been some complaints re low water pressure in Sixmilebridge,
particularly in the Church View area. We will the monitor the pressure
in this area over the next few weeks and take remedial action if possible.

With reference to Notice of Motion No. 11, submitted by Cllr. P. McCarthy,
for the Shannon Electoral Area Committee Meeting, on 18th July, 2006,
That a report be provided detailing trees that have been identified for
removal and or cutting back in the Cluain Airne/Tradaree Court Area.
I wish to reply as follows:-
I will organise a joint inspection of the trees in the Cluain Airne and
Tradaree Court estates between Clare County Council staff and an experienced
tree surgeon. A schedule of work outlining tree felling and tree pruning
requirements will be compiled which will presented to County Councillors
for discussion at the next electoral area meeting.

With reference to Notice of Motion No. 12, submitted by Cllr. P. McMahon,
for the Shannon Electoral Area Committee Meeting, on 18th July, 2006,
That Clare County Council put traffic calming measures and double yellow
lines on the road leading to the Newmarket on Fergus family centre.
I wish to reply as follows:-
Parking on this road is normally confined to the western side of the
road, which allows orderly movement of traffic along the road. Occasionally
some cars park on the eastern side, which leads to access problems. The
provision of double yellow lines would be of benefit in these circumstances.
I will consult with the Gardaí on this issue and providing they
have no objections I will arrange for bye-laws to be drafted prohibiting
parking on the eastern side of this estate road.
I do not believe traffic-calming measures are needed along this cul-de-sac
road. Traffic speeds have been observed to be low and the parked cars
in front of houses have the same effect as horizontal build-outs, which
reduce the speed of vehicles exiting the cul-de-sac road, as motorists
must yield to incoming traffic.

With reference to Notice of Motion No. 13, submitted by Cllr. G. Flynn,
for the Shannon Electoral Area Committee Meeting, on 18th July, 2006,
That recently installed traffic ramps through Ard na Greine be continued
through Tullyvarraga Crescent Road – this section of road is being
used as a rat run for vehicles
I wish to reply as follows:-
This year’s allocation of funds for the provision of traffic ramps
in the Shannon electoral area have been expended following the installation
of traffic ramps in Cul na Ceapa and Ard na Gréine. It is therefore not
possible at present to extend the traffic calming scheme from Ard na Gréine
through Tullyvarraga Crescent as far as the St. Conaire’s school
road. I will arrange for a vehicle count and speed survey to be carried
out as soon as the schools re-open to establish if Tullyvarraga Cresent
is being used as a rat run for vehicles and to determine how effective
the recently installed ramps are in Ard na Gréine.

With reference to Notice of Motion No. 14, submitted by Cllr. J. Crowe,
for the Shannon Electoral Area Committee Meeting, on 18th July, 2006,
I am requesting the provision for car parking to be made at the Little
Church Sixmilebridge
I wish to reply as follows:-
At present, there is provision for approximately 4 car-parking spaces
in the lay-by in front of the little church on the R462 Regional road
in Sixmilebridge. I accept that the parking provision at this location
is insufficient and that traffic congestion occurs on the public road
when church services take place due to the amount of parked cars on the
road. I will liase with the Planning section with a view to selecting
locations within the village suitable off-street parking and determining
access to these locations. In assessing future applications for commercial
and residential developments from a roads perspective I will ensure that
the parking provisions are complied with as outlined in the South Clare
Economic Corridor Local Area Plan.

With reference to Notice of Motion No. 15, submitted by Cllr. P. McCarthy,
for the Shannon Electoral Area Committee Meeting, on 18th July, 2006,
That Clare County Council advise if there is a reason why refuse trucks
cannot/are not using the road between Ennis Road Houses and Kilnasoolagh
for bin collection.
I wish to reply as follows:-
The internal radii of the lane-way to the rear of House Nos. 1-18 fronting
onto the Ennis Road and House Nos. 1- 26 in Kilnasoolagh Park in Newmarket
on Fergus are too small to cater for the refuse lorries which are being
used by the refuse / recycling companies that operate in the area. Refuse
bins are normally placed on the kerbside in front of the customer’s
house and this is usually a condition within the contract between the
customer and the refuse / recycling company.

With reference to Notice of Motion No. 16, submitted by Cllr. P. McMahon,
for the Shannon Electoral Area Committee Meeting, on 18th July, 2006,
That Clare County Council alleviate the flash flooding at Lemanagh Mór
in the vicinity of Corry’s residence as it can cause a danger to
motorists and pedestrians.
I wish to reply as follows:-
Flooding is occurring at this location as a direct result of site development
works, which have taken place in constructing a dwelling house. The owners
of the house have not complied with their conditions of planning with
respect to preventing flooding of the public roadway. I have referred
this matter to the planning enforcement section of Clare County Council
recommending they seek compliance of the planning conditions from the
owners.

With reference to Notice of Motion No. 17, submitted by Cllr. G Flynn,
for the Shannon Electoral Area Committee Meeting, on 18thJuly, 2006,
That Clare County Council in consultation with the local residents draw
up a comprehensive plan for the re-generation of the Finian Park and Aidan
Park areas
I wish to reply as follows:-
The extent and nature of the works required in terms of re-generation
would have to be clearly indicated in order to provide a comprehensive
response to this notice of motion. However, it would appear that this
may require the preparation of a Local Area Action Plan, or similar type
plan, for these 2 residential estates in Shannon. There would be a significant
resource issue involved with the preparation of this type of plan and
consideration should be given at an estimates meeting in order to establish
appropriate resources can be made available to undertake same.
The selection of two residential estates over other any other in Shannon
should be looked at before any final decision is made in order that a
fair and transparent selection process is evident.
The issue of the extent of Council responsibility for these 2 residential
areas would also have to be assessed given that in the main, these are
private residential estates.

With reference to Notice of Motion No. 18, submitted by Cllr. J. Crowe,
for the Shannon Electoral Area Committee Meeting, on 18th July, 2006,
There are a lot of houses and people walking to Kilmurry village from
the Ardane road. This road needs to be strengthened, resurfaced and provided
with a footpath. I request this be done as soon as possible
I wish to reply as follows:-
This section of roadway is scheduled for improvement this year as part
of the Multi Annual Plan for Regional and County roads. Drainage improvement
works are currently being carried out in advance of resurfacing works
taking place. At present, it is not possible to provide a footpath with
associated public lighting due to budgetary constraints and limited finance
available through planning contributions for roads in the Sixmilebridge
and Kilmurry area. Hard shoulders will however be delineated, which will
enable pedestrians to walk in relative safety along the road. I am conscious
that pedestrians have to walk on the roadway outside the grass verge between
the T-junction and Neenan’s shop. It is my intention to improve
pedestrian safety by constructing a macadam path through this grassed
area when carrying out the resurfacing works.
