With reference to Notice of Motion no. 5, submitted by Cllr. P. McCarthy,
for the Shannon Electoral Area Committee Meeting, on 20th June, 2006
That the Planning Section advise how many enforcement notices
- have issued in the Shannon Electoral Area in the period April 1st
2005 to April 30th 2006
- how many relate to single houses,
- to housing developments,
- to commercial/industrial developments,(e)the outcome/current position
of such notices
I wish to reply as follows:-
Seventeen enforcement notices have been served in the Shannon Electoral
area in the period 1st April, 2005 to 30th April, 2006. The following
is the breakdown of the enforcement notices:
Number of Single Houses - 3
Number of Housing Developments - 5
Number of Commercial/Industrial - 9
The following is the outcome/current position of such notices:
Under Review - 9 (Enforcement notices served recently)
Legal Proceedings - 2 (Served recently)
Cases Closed - 6 (Notices complied with – 4, Legal proceedings –
2 (1 case withdrawn with expenses paid and fines and expenses paid in
second case))

With reference to Notice of Motion no. 6, submitted by Cllr. G. Flynn,
for the Shannon Electoral Area Committee Meeting, on 20th June, 2006
That Clare County Council would facilitate the operations of B&B
accommodation in the Shannon Electoral area by putting in place some policy
that will allow these business people engage with Clare County Council
in part funding additional signage to help save their futures
I wish to reply as follows:-
The erection of signage by businesses (including B&Bs) throughout
the County comes under the provisions of the Planning and Development
Act 2000 and Planning and Development Regulations 2001. There is a requirement
for a licence to be issued by the Planning Authority if a sign is to be
erected on a public road and the current annual licence fee for such sign
is €50.00 per fingerpost sign. Signs on public roads that are not
fingerpost signs are subject to an annual licence fee of €630.00.
Signs on private property are subject to the requirement to apply for
planning permission except where such signage is exempted by the provisions
of Part 2 (Article 6) of the Planning and Development Regulations 2001.
The approval of any signage is subject to a detailed assessment of each
individual proposal.
The fees for such licences and applications for planning permission are
prescribed in Schedule 12 and Schedule 9 of the Planning and Development
Regulations 2001 and are outside the direct control of the Planning Authority.
It is not appropriate for the Council to provide funding towards the
advertising of commercial activities.

With reference to Notice of Motion no. 7, submitted by Cllr. J. Crowe,
for the Shannon Electoral Area Committee Meeting, on 20th June, 2006
The Drumline Road starting at Noel McInerneys house to Ralahine needs
attention as it is very uneven and is causing major flooding around Paddy
O Donoghues house
I wish to reply as follows:-
Road construction is required on this road. It is anticipated that a
section of the road will be strengthened in 2007 and the rest in 2008.

With reference to Notice of Motion no. 8 submitted by Cllr. P. McMahon,
for the Shannon Electoral Area Committee Meeting, on 20th June, 2006
That Clare County Council would address the on going flooding problem
at Ballinoosky, Urlanmore as this is causing a major traffic hazard and
a major irritant to people living in the area.
I wish to reply as follows:-
Surface water at this location discharges to soakaways. I will arrange
to have these soakaways dug out, enlarged and filled with new stone in
order to increase their capacity and alleviate the flooding. I will monitor
the on going situation and provide extra soakaways if necessary.

With reference to Notice of Motion no. 9, submitted by Cllr. P. McCarthy,
for the Shannon Electoral Area Committee Meeting, on 20th June, 2006
That work commence on the agreed improvements works at the entrance to
Lemenagh burial ground
I wish to reply as follows:-
The provision of measures to prevent illegal parking along the frontage
of the burial ground over a length of approximately 100 metres is estimated
to cost €25000. These works have not progressed due to the necessity
to assign available funds to upgrading and improving services generally
throughout the electoral area. In order for the works to be undertaken
it will be necessary to provide funding for this purpose from a specific
budget heading.

With reference to Notice of Motion no. 10, submitted by Cllr. G. Flynn,
for the Shannon Electoral Area Committee Meeting, on 20th June, 2006
That Clare County Council roads section would give a report concerning
the junction of the Stonehall Road going on to the R472 a number of incidents
have occurred at this junction which may require better road marking and
signage
I wish to reply as follows:-
I have arranged for the provision of stop lines and additional signage
at this location.

With reference to Notice of Motion no. 11, submitted by Cllr. J. Crowe,
for the Shannon Electoral Area Committee Meeting, on 20th June, 2006
The hedges in the Shannon Electoral area need urgent attention due to
the strong growth over the last couple of weeks. I am requesting that
these hedges are cut and trimmed
I wish to reply as follows:-
Verge trimming is presently in progress in the area in order to ensure
adequate sight distance at road junctions and bends etc.

With reference to Notice of Motion no. 12, submitted by Cllr. P. McMahon,
for the Shannon Electoral Area Committee Meeting, on 20th June, 2006
“That Clare County Council give a report on the expected date of
the commencement of the Newmarket water supply scheme as there are a lot
of leaks occurring along the Main Street and the Ballycar Road.”
I wish to reply as follows:-
The advertisement seeking tenders for the above will be in the newspapers
during W/E 21st June 2006. The tender period allowed will be eight weeks
from this date. Tenders will be received in mid August 2006 with a report
on tenders, assuming no abnormal tender difficulties, available by the
end of September 2006. It should be possible based on this timetable to
commence works on the scheme on site in late October/ early November 2006.

That Road markings be provided on the Drumline Road immediately after
the Junction with the Old N18

With reference to Notice of Motion no. 14, submitted by Cllr. G. Flynn,
for the Shannon Electoral Area Committee Meeting, on 20th June, 2006
That Clare County Council give a report concerning sewerage problems
affecting house numbers 10 and 11 Tullyvarraga Hill, the residents in
this area are suffering with problems of bad odour in the area and overflow
on occasions
I wish to reply as follows:-
The public foul sewer and public storm sewer manholes in the public pathway
fronting the above houses were inspected on Friday 15th June and found
to be clear. These main collector sewers were flushed on Monday 19th June
to ensure that there was no obstruction between manholes and none was
found. It is likely that whatever odour is present, is emanating from
some source other than the main public collector sewers.

With reference to Notice of Motion no. 15, submitted by Cllr. J. Crowe,
for the Shannon Electoral Area Committee Meeting, on 20th June, 2006
The two new housing estates on the Rosmanagher Road have been completed
for the last 6 years and have no footpath or lighting leading to Sixmilebridge
and I am asking that this matter should be addressed immediately.
I wish to reply as follows:-
The provision of a footpath at this location has recently been progressed
the setting back of roadside developments which has resulted in ground
being available for a new footpath. I am presently arranging to have some
existing services relocated to allow construction of the footpath. I am
endeavoring to ensure that work will commence as soon as possible.

With reference to Notice of Motion no. 16, submitted by Cllr. P. McMahon,
for the Shannon Electoral Area Committee Meeting, on 20th June, 2006
I will ask Clare County Council to upgrade the footpath in Ballinacragga,
Newmarket on Fergus due to high increase of usage
I wish to reply as follows:-
This is a graveled footpath, which is 0.75miles long and connects the
main entrance to Dromoland Castle Hotel to Newmarket on Fergus village.
The estimated cost of resurfacing this path with bituminous macadam would
be approximately €50000. I am aware that usage of this path has increased
in recent times and I will keep this in mind when considering the allocation
of funding for upgrading of footpaths.
