of Motion May 17th 2005
With reference to Notice of Motion No. 5 submitted by Cllr. P. McMahon
for the Shannon Electoral Area Committee Meeting on 17th May, 2005,
“To ask Clare County Council for an update on the provision of
a playground in Newmarket on Fergus”
I wish to reply as follows:
The Play Policy and Action Plan for Clare 2004-2008 was launched in September
2004. The Play Policy Group is meeting on a regular basis, overseeing
the implementation of the Plan. The Council has given a commitment to
set up a playground in each electoral area. The matter was the subject
of a motion at the May 2005 Council meeting. An implementation approach
will be further developed over the coming months.

With reference to Notice of Motion No. 6 submitted by Cllr. P. McCarthy
for the Shannon Electoral Area Committee Meeting on 17th May, 2005,
“That an update be provided on the replacement programme for the
water mains in Tola Park and Tullyvarraga.”
I wish to reply as follows:
Preparatory work for the replacement of watermains at Tola Park has commenced,
and we intend to commence pipelaying before the end of May. The replacement
of watermains at Tullyvarraga will follow the completion of works at Tola
Park.

With reference to Notice of Motion No. 7 submitted by Cllr. G. Flynn
for the Shannon Electoral Area Committee Meeting on 17th May, 2005,
“That Clare Co. Council ensure that a specific Budget is allocated
for the running of Shannon Town and that a report be presented to the
Area Councillors outlining what provisions can be made in the estimates
for the County for such a budget.”
I wish to reply as follows:
Section 102 of the Local Government Act 2001 states that the “
Local Authority Budget shall be prepared under the direction of the Manager
in the format prescribed by regulations made by the Minister” .
Therefore in accordance with the Act the County prepares its budget on
a Programme Group basis and not on an area or town basis. Within each
of the Programme Groups provision is made subject to budgetary contraints
for Towns and Electoral Areas for eg. Roadworks Programme.

With reference to Notice of Motion No. 8 submitted by Cllr. P. McMahon
for the Shannon Electoral Area Committee Meeting on 17th May, 2005,
“To ask Clare County Council to put in place a speed limit between
Bunratty Wood B&B and the approaching entrance to the Folk Park, Bunratty
due to the wreckless driving of a minority of motorists”
I wish to reply as follows:
This B&B property is located within a cluster of houses approximately
600 metres beyond the existing 60 km/h speed limit, on the Low Road, Bunratty.
The speed limit of 80 km/h applies at these houses. There is no development
along the 600 metre stretch of road. The speed limit guidelines require
continuous development on at least one side of the road to justify extension
of the speed limit. For this reason, I cannot recommend extending the
speed limit as requested in this notice of motion.

With reference to Notice of Motion No. 9 submitted by Cllr. P. McCarthy
for the Shannon Electoral Area Committee Meeting on 17th May, 2005,
“That the footpaths connecting Rossbracken with the Town Centre
be replaced as they are subject to flooding and in bad condition”
I wish to reply as follows:
It is acknowledged that some roads and footpaths in Rossbracken need
improvement. I am aware through discussions with the Housing Section of
the Council, that funding from the Department is expected to be available
for upgrading of the Rossbracken Estate. In the meantime I will try to
ensure that improvements to roads and footpaths in Rossbracken are carried
out in as much as is possible. In this context the road fronting No’s
31 - 42 Rossbracken, will be resurfaced shortly.

With reference to Notice of Motion No. 12 submitted by Cllr. P. McCarthy
for the Shannon Electoral Area Committee Meeting on 17th May, 2005,
“That an update be provided on the provision of the Pedestrian
Crossing and footpath to serve Dun Aras, Ballycasey”
I wish to reply as follows:
It has been agreed at a previous Area Meeting to provide a pedestrian
crossing and associated footpaths at this location. However, a special
speed limit of 50 km/h needs to be provided here before constructing the
pedestrian crossing. It is envisaged that this will be included as part
of the upcoming speed limit review.
