With reference to Notice of Motion no 6, submitted by Cllr. P McMahon, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
To ask Clare County Council to improve the roads and infrastructure of Woodland Heights, Newmarket on Fergus.

The road serving this estate required strengthening. It is intended to strengthen this road as part of the 2008 Road Works Programme

With reference to Notice of Motion no 7, submitted by Cllr. P McCarthy, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
That the Council consider providing a speed table in the vicinity of the Post Office in Sixmilebridge to slow traffic in the interest of road and pedestrian safety.
I wish to reply as follows:-
I have reservations regarding the provision of a speed table at this location other than as part of a pedestrian crossing. A pedestrian crossing at this location was recently considered at Area Meetings and the location was considered unsuitable. I would favour the consideration of another location on Pound Street such as on the town side of the Car Parking Area near the Church where the loss of car parking spaces would be less. I will discuss this matter with the Senior Executive Engineer, Road Design, with a view to the provision of a zebra crossing/speed table while retaining existing car parking as much as possible

With reference to Notice of Motion no 8, submitted by Cllr. J Crowe, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
To ask the Area engineer that Clare County Council install a ramp or other traffic calming measures at Ballynacragga, Newmarket on Fergus.
I wish to reply as follows:-
This is a lightly traffic road where the road users are generally local residents. There is a 50kph speed limit in place. Traffic calming is not warranted on this road.

With reference to Notice of Motion no 9, submitted by Cllr S McLoughlin, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
To ask Clare County Council to remove the abandoned car, and all litter cans and bottles and clean up the riverside walks in Shannon.

I will arrange to have all litter picked on the riverside walks as soon as possible. Arrangements will be made to have the abandoned car removed.

With reference to Notice of Motion no 10, submitted by Gerry Flynn, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
That Clare County Council Housing Section give an update on the remedial re-generation scheme in Inis Ealga Estate.
I wish to reply as follows:-
The contract for the Remedial Works scheme for Inis Ealga was signed in January 2008 and the contractor went on site on 18th February 2008. The contractor is DMB Construction. At present the works consist of laying foundations at the rear of houses 1 – 30 and this work is almost complete. Works on the electrics are also underway in houses 1 and 4 and these will progress to other houses, as appropriate.
The Estate Management Officer is liasing with the residents as required, and assisting them in preparing for the works.
It is expected that the contract will run for a period of 12 months. The agreed price for the work is €1,296,614, which is considerably lower than the budget cost approved by the Department of the Environment, Heritage and Local Government. A similar situation arose with the former Shannon Development houses (53) and a contract has been signed for €1,259,258. On foot of these lower contract prices, I have made a submission to the Department of the Environment, Heritage and Local Government to transfer these savings to the refurbishment of Rossbracken estate. On receipt of a response, I will notify the Council.

With reference to Notice of Motion no 11, submitted by Cllr. P McMahon, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
Due to the extra amount of traffic that Clare County Council put a plan in place to improve the road structure in Drumline Newmarket on Fergus.
I wish to reply as follows:-
The surface of this road is in very good condition as the road was strengthened a couple of years ago. At the same time road drainage was improved and the carriageway was widened locally wherever possible. The council will endeavour to maintain this road in good condition.

With reference to Notice of Motion no 12, submitted by Cllr. P McCarthy, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
That Developers and the Council should properly advise residents of the implications of the Taking in Charge of Estates by the Council and their rights during the process.

"Section 180 of the Planning and Development Act refers to the taking in charge of estates. The Council's Taking In Charge policy for Private Housing Developments informs developers of their obligations and the general public of the Councils commitment in respect of the taking in charge of public lighting, roads and footpaths, watermains, surface water sewers, foul sewers and open spaces. The current policy is available on the Councils website. The statutory process under Section 11 of the Roads Act 1993 provides an opportunity for the public to make submissions/observations in respect of a proposed declaration. ".

With reference to Notice of Motion no 13, submitted by Cllr J Crowe, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
I am requesting that the Public Lighting in Kilmurry be extended into the Ardane Road, the Rossroe Road and the Ardmaclancy Road.

The Council recently advertised the 2008 Community Public Lighting Scheme. The closing date for receipt of applications is 31st March. I understand the local community in Kilmurry has made an application for public lighting in the areas set out in the Notice of Motion.

With reference to Notice of Motion no 14, submitted by Cllr S McLoughlin, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
To ask Clare County Council due to great concern of residents to get the owner of the land on Drumgeely Hills as a matter of urgency to remove the fence around the tennis court and clean up the site of the Old Hall.
I wish to reply as follows:-
The Council served the appropriate notices under the Derelict Sites Act 1990 on the Owner in July 2007. The notice required that the site would be cleared and landscaped.
The Owner contacted the Council to indicate that he had complied with the Notice and rendered the site non-derelict.
Report and photographs would indicate that the site is cleared and fenced and has been rendered non derelict within the meaning of the Act.
The Derelict Sties Act can only provide for making the site non-derelict but it cannot require the re-development of the site by way of re-building etc.

To ask Clare County Council to improve the roads and infrastructure of Avondale Estate due to extra traffic.
I wish to reply as follows:-
Sections of this estate road have been subject to potholing. Road resurfacing is required to eliminate this problem. It is intended to resurface the sub-standard sections of this road during 2008.

With reference to Notice of Motion no 17, submitted by Cllr. P McCarthy, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
That the poplar trees on the riverside of the Camogie Pitch be examined with a view to removing the dangerous ones and replanting with a more suitable tree.
I wish to reply as follows:-
I have inspected these trees and none appear particularly dangerous. I will have these trees examined by the Tree Surgeon as soon as can be arranged. Further action will be considered based on his inspection.

With reference to Notice of Motion no 18, submitted by Cllr. J Crowe, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
Ashview Drive Sixmilebridge – Ashview Drive has a number of young families and I am requesting with the take over of the estate by Clare County Council that traffic calming measures be put in Place.

The developers of this estate has requested the Council to take the estate in charge. The Council is presently considering this request. The layout of the roads in this estate is such that traffic calming is achieved by the layout without the need for any additional traffic calming measures.

With reference to Notice of Motion no 19, submitted by Cllr Gerry Flynn, for the Shannon Electoral Area Committee Meeting, on 25th March, 2008,
That Clare County Council clean out all passageways to the rear and side of all the older housing estates in Shannon and put in proper standard size gullies.
I wish to reply as follows:-
When these older housing estates were constructed surface water arising within the narrow passageways drained to the rear gardens abutting the passageways. This method of drainage has been impaired owing to the construction of garden boundary walls. In some cases this has let to flooding of the passageways during wet weather. This in turn can result in dirty surfaces requiring cleaning. In most cases the local residents will carry out this cleaning where this is not happening I will arrange to have these areas cleaned. Domestic type gullies have been installed in some of these passageways. I will arrange to have these replaced, where feasible, by standard road drainage gullies.
