Area Council Meetings : Replies to Notices of Motion January 18th 2005

With reference to Notice of Motion No. 4 submitted by Cllr. P. McMahon, for the Shannon Electoral Area Committee Meeting on the 21st December, 2004.

“I wish to ask Clare County Council for an up-date on the Newmarket-on-Fergus Sewerage Scheme due to the increasing demands as a result of the new developments in the area."

I wish to reply as follows:

Clare County Council advertised the Part VIII for Newmarket on Fergus Wastewater Treatment Plant extension on 16th May 2003. Since that time, additional information has been requested by the Department of the Environment, Heritage and Local Government (Development Applications Unit) because the receiving water is a candidate Special Area of Conservation. A particular concern of the DEHLG in their last letter of additional information related to the present phosporate loading on the lake and the projected phosphorate loadings on the lake following the expansion of the plant and the installation of phosphorate removal as part of the treatment process. The Council replied to the DEHLG in September 2004 and are awaiting a reply to its letter. Until such time as the DEHLG (Development Applications Unit) signs off on the proposal to expand the wastewater treatment plant, it is not possible to complete the Part VIII process and proceed to the next stage of planning for the Scheme.

With reference to Notice of Motion No. 5 submitted by Cllr. G. Duff, for the Shannon Electoral Area Committee Meeting on the 21st December, 2004.

"That Clare County Council will take a leadership role in the developing of a main street for Shannon Town".

I wish to reply as follows:

It is an objective of the 2003 South Clare Economic Corridor Local Area Plan that a master planning approach is taken to the development of Shannon Town Centre. A critical part of this approach will include the creation of new streetscapes for the TC2 and TC3 areas. The masterplan(s) will be prepared in conjunction with landowners who will be required to submit joint integrated proposals to enable a comprehensive planned approach to be taken to deliver development and services for the town centre.

Clare County Council is already in discussions with Murray O’Laoire Architects and Town Planners to develop a design brief to masterplan the areas identified in the local area plan as TC2 and TC3. It is the intention of the Council in dealing with individual planning applications in the existing and extended town centre areas to create a strong north/south axis, to ensure frontage buildings have a high quality design, proportion and finishes, to allow for mixed use developments and to prioritise a north/south pedestrian link/spine which will create a focal point for the development of the town centre.

With reference to Notice of Motion No. 6 submitted by Cllr. P. McCarthy, for the Shannon Electoral Area Committee Meeting on the 18th January, 2005.

“That Clare County Council provide a solution for the ongoing sewage problems at Dún an Óir, Shannon.”

I wish to reply as follows:

There have been 4 No. incidences of blocked sewers in Dún an Oir since 6th Sept ’04 and they were all cleared within reasonable time. We had been advised of recurring problems at Nos. 36 and 20 Dún an Óir prior to the “takeover” and in fact a problem did occur in No. 20 in Dec ’04 and this was cleared by our maintenance crew.

We had a CCTV survey carried out on the sewer network in this estate and will examine the problem areas with a view to repairing and /or relaying these sections in 2005.

With reference to Notice of Motion No. 7 submitted by Cllr. G. Flynn, for the Shannon Electoral Area Committee Meeting on the 18th January, 2005.

“That Clare County Council retain the Courthouse in Sixmilebridge for the use of the community in providing facilities for a Day Care Centre and other services.”

I wish to reply as follows:

It is the intention of the Council that the Courthouse in Sixmilebridge would be transferred over to the community in Sixmilebridge and preliminary contact in this regard has already been made with the Council. It would make sense for an umbrella body to be formed in the village who would take on the responsibility for the premises and the various interested parties could then be accommodated via that umbrella body. An arrangement along the lines of the above is already in train as regards the Courthouse in Tulla. The interested parties in Sixmilebridge are welcome to contact the undersigned and in due course a proposal to lease the premises subject to appropriate conditions will be brought before the elected members for their consideration.

With reference to Notice of Motion No. 8 submitted by Cllr. J. Crowe, for the Shannon Electoral Area Committee Meeting on the 18th January, 2005.

“The Sixmilebridge to Newmarket Road starting at houses belonging to Burns, Meehans and Murrays, the road is now in an appalling condition due to the constant erosion caused by the weather conditions and the constant flow of water. I am urging Clare County Council that a drainage system be put in place as a matter of urgency.”

I wish to reply as follows:

I recommend that road gullies be installed at this location and I will arrange to have this done as soon as possible.

"I wish to ask Clare County Council to install speed ramps at Goodwood Housing Estate, Newmarket-on-Fergus in an effort to reduce speeding in the area."

I wish to reply as follows:

Clare County Council is in the process of adopting guidelines for the installation of speed ramps. I am aware this matter was discussed at an S.P.C. Meeting on 13th January, 2005, with a view to progressing the adoption of new guidelines.

I recommend that the installation of speed ramps be considered on the basis of these guidelines, when their adoption is clarified.

With reference to Notice of Motion No. 10 submitted by Cllr. G. Duff, for the Shannon Electoral Area Committee Meeting on the 18th January, 2005.

“That Clare County Council liase with Shannon Development to address the need to widen the road and introduce other safety measures at the main entrance on Smithstown Road to the Smithstown Service Area.”

I wish to reply as follows:

The through road at this location, known as the concrete road, is a public road maintained by the Council. The road to the Smithstown Industrial Estate, which opens off the public road, is maintained by Shannon Development.

I recommend that this Notice of Motion be referred to the Road Design Section of Clare County Council, for evaluation regarding upgrading at this junction. I will arrange to assist the Road Design Section by carrying out any necessary traffic counts etc. The Council will liaise in this matter with Shannon Development.

With reference to Notice of Motion No. 11 submitted by Cllr. P. McCarthy, for the Shannon Electoral Area Committee Meeting on the 18th January, 2005.

“That Clare County Council consider an enhancement scheme for Corrib Drive, Shannon.”

I wish to reply as follows:

Corrib Drive is indeed an unusual boulevard-style road, which considerably enhances this area. I recommend that Corrib Drive be considered as a suitable location for an Urban and Village Renewal Scheme.

New footpaths will be provided on Corrib Drive during 2005, under the Footpath Contract presently underway. Road re-surfacing will be carried out on Corrib Drive as soon as possible, subject to prioritisation of roads in the light of the available funding.

“That Clare County Council put in place Playgrounds in Sixmilebridge and Newmarket on Fergus.”

I wish to reply as follows:

The Play Policy and Action Plan for Clare 2004-2008 was launched on 18th September 2004. The first meeting of the Play Policy Implementation Group was held on the 10th December. The Council has given a commitment to set up a playground in each electoral area. Progress on this will be made over the coming months.

With reference to Notice of Motion No. 13 submitted by Cllr. J. Crowe, for the Shannon Electoral Area Committee Meeting on the 18th January, 2005.

“I am requesting that the County Engineer approach the E.S.B. and Eircom with regard to the on-going problem that exists with the development of new houses and the changing of boundary walls which leave the E.S.B. and Eircom poles in the same position meaning they now protrude out onto the road and are a danger to road users.”

I wish to reply as follows:

The subject matter of this motion has been considered on quite a number of occasions by the SPC, various Electoral Area Meetings and the full Council. The ESB and Eircom have also been approached. Eircom and ESB have made it very clear that the need for re-location of poles arises directly from the new development and in no circumstances should they be liable for the cost of re-locating any services. They will of course re-locate a pole provided that the developer pays the associated costs. It must be considered therefore, that where the need arises, re-location of poles is an integral part of site development costs.

"I would ask Clare County Council to repair the footpaths on the Ballycar Road in Newmarket on Fergus."

I wish to reply as follows:

It was intended during 2004 to carry out re-surfacing of some bad footpaths in Newmarket on Fergus, including on the Ballycar Road. However due to pressure of work it was not possible to resurface these paths at that time. It is now intended to resurface these paths in the near future.

With reference to Notice of Motion No. 15 submitted by Cllr. G. Duff, for the Shannon Electoral Area Committee Meeting on the 18th January, 2005.

“In order to address excessive speeding by some drivers in the area of the pedestrian crossing at the Lisheen end of Bóthar na Rinne. An examination of possible safety measures will be undertaken by Clare County Council.”

I wish to reply as follows:

I recommend that a speed ramp be installed at this pedestrian crossing which will improve safety for pedestrians and act as a traffic calming measure generally.

With reference to Notice of Motion No. 16 submitted by Cllr. P. McCarthy, for the Shannon Electoral Area Committee Meeting on the 18th January, 2005.

"That Clare County Council present a report on what progress is being made on bringing all the land north of the Bóthar Mór, Shannon (R471) into productive use in the immediate future."

I wish to reply as follows:

Since the adoption of the South Clare Local Area Plan a limited amount of progress has been made on the preparation of a master plan for that area of land at Shannon zoned TC2 and TC3.

Work done includes the completion of a land registry search, which has determined the ownership of parcels of land in the area. Also, contact has been made with a town planning consultant, a preliminary consultants brief has been prepared and costing of same is currently being prepared by the consultant. Proposed future activity will involve meeting with individual landowners and interested groups and agencies to determine future plans for land usage; the preparation of a working draft development plan for presentation and discussion with landowners, council members and other interested parties; publication of a draft masterplan for wider consultation.

Work is due to commence on the review of the South Clare Local Area Plan in February/March 2005 with a completion date of July/August 2005 for incorporation into the Local Area Plan. The lack of a Forward Planner for that area until February ’05 will result in some delay in delivery of the review.

“That Clare County Council construct a new footpath from the GAA Slí na Mara road in Shannon to the Cronan Estate area as the current footpath is in a state of disrepair.”

I wish to reply as follows:

This footpath is used by a lot of people. Most of the path needs re-surfacing. I recommend that re-surfacing be carried out during 2005, as soon as proves feasible.

“I have been approached by residents of the new estate Oakwood in Sixmilebridge, with the possibility of erecting speed ramps in same and I am asking Donal Hogan, Area Engineer, to look into this matter.”
